1. Acceptance of Terms of Use Agreement:

Upon creating a Mango account, you agree to abide by (i) these Terms of Use, (ii) our Privacy Policy, Cookie Policy, Arbitration Procedures (if applicable to you), Safety Tips, all of which are incorporated into this Agreement by reference, and (iii) any terms provided and accepted by you when purchasing additional features, products, or services offered by us on the Service. If you do not fully accept and agree to comply with all the terms set forth in this Agreement, kindly refrain from using the Service.

Furthermore, please note that we reserve the right to periodically modify this Agreement and the Service itself. These modifications may be made to conform with legal requirements, introduce new features, or adapt to changes in our business practices. The most recent version of this Agreement will be made available on the Service under Settings and Mango.com. Therefore, we recommend that you regularly check for any updates. In the event of substantial changes that may affect your rights or obligations, we will provide notice of such changes at least 30 days before they take effect, unless prohibited by applicable law. This notice will be provided through reasonable means, including but not limited to notification on the Service or via email. By continuing to use the Service after the revised Agreement becomes effective, you are indicating your acceptance of the updated terms.

2. Eligibility:

2. You are strictly prohibited from creating an account, accessing, or using the Service or any related systems, unless all of the following conditions are met:

• You are at least 18 years of age.
• You possess the legal capacity to enter into a binding contract with Mango.
• You agree to comply with this Agreement, as well as all applicable local, state, national, and international laws, rules, and regulations.
• You have never been convicted of a felony or indictable offense (or a similarly severe crime), a sex crime, or any crime involving violence. Moreover, you are not required to register as a sex offender on any state, federal, or local sex offender registry.

3. Your Account

To access Mango, you have various login options, including signing in through Facebook, Google. If you choose to use your Facebook login, you grant us permission to access and utilize specific information from your Facebook account, including your public profile. For further details on the data we collect and how we handle it, please refer to our Privacy Policy.

It is your responsibility to keep your login credentials for Mango confidential, and you are solely accountable for any activities carried out under your credentials. If you suspect unauthorized access to your account, please contact us immediately.

4. Modification of the Service and Termination

At Mango, we consistently strive to enhance the Service and provide you with additional features that are engaging and beneficial. As a result, we may introduce new product features or improvements periodically, and we reserve the right to eliminate certain features. Unless these actions significantly affect your rights or obligations, we may not provide prior notice. In exceptional circumstances, such as safety or security concerns, we may need to suspend the Service without advance notice.

To terminate your account, you can conveniently follow the instructions under the Settings section of the Service. Alternative termination options are also available. However, if you have made in-app purchases through third-party payment accounts like Apple's App Store or Google Play Store, you must manage those purchases through the respective account to avoid additional charges. Mango reserves the right to terminate your account at any time and without notice if we believe you have violated this Agreement. In such cases, no refunds will be provided for any purchases made.

For residents of the Republic of Korea, we will promptly notify you of the reasons for any relevant actions unless we reasonably determine that (i) providing notice is legally prohibited (e.g., violating applicable laws, regulations, or orders from regulatory authorities), or (ii) issuing a notice may cause harm to you, third parties, Mango, and/or our affiliates (e.g., compromising the security of the Service).

Upon termination of your account, this Agreement will also terminate, except for the provisions that still apply to you and Mango: Section 4, Section 5, and Sections 12 through 19.

5. Safety: Interacting with Other Members

Mango endeavors to foster a respectful member experience through features such as the double opt-in process, enabling communication between members only after mutual interest is established. However, please note that Mango cannot be held responsible for the actions of any member, whether on or off the Service. We urge you to exercise caution when engaging with other members, especially if you choose to communicate outside the Service or arrange in-person meetings. Additionally, we kindly request that you familiarize yourself with Mango's Safety Tips before utilizing the Service. Under no circumstances should you divulge your financial information, such as credit card or bank account details, and refrain from sending money to other members.

YOU BEAR SOLE RESPONSIBILITY FOR YOUR INTERACTIONS WITH OTHER MEMBERS. PLEASE BE ADVISED THAT MANGO DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS OR INQUIRE INTO THE BACKGROUND OF ITS MEMBERS. MANGO DISCLAIMS ANY REPRESENTATIONS OR WARRANTIES REGARDING THE CONDUCT OR COMPATIBILITY OF MEMBERS.

6. Rights Granted by Mango

6. Mango grants you a personal, non-transferable, non-exclusive, revocable, and non-sublicensable license, valid worldwide, to access and use the Service. This license is solely intended to allow you to benefit from and enjoy the intended features and advantages of the Service, as outlined in this Agreement. However, this license and your authorization to access the Service will automatically be revoked if you engage in any of the following activities:

• Use the Service or any content within it for commercial purposes without obtaining our written consent.
• Copy, modify, transmit, create derivative works from, utilize, or reproduce copyrighted material, images, trademarks, trade names, service marks, or other intellectual property, content, or proprietary information accessible through the Service without prior written consent from Mango.
• Misleadingly state or imply that any statements you make are endorsed by Mango.
• Employ any means, including but not limited to robots, bots, spiders, crawlers, scrapers, site search/retrieval applications, proxies, or other manual or automated devices, methods, or processes to access, retrieve, index, data mine, or in any way replicate or circumvent the navigational structure or presentation of the Service or its contents.
• Utilize the Service in any manner that could interfere with, disrupt, or have a negative impact on the Service or the servers or networks connected to it.
• Upload viruses or other malicious code, or compromise the security of the Service in any manner.
• Forge headers or manipulate identifiers to disguise the origin of any information transmitted to or through the Service.
• Frame or mirror any part of the Service without prior written authorization from Mango.
• Use meta tags, code, or any other devices containing references to Mango, the Service, or any trademarks, trade names, service marks, logos, or slogans of Mango, to direct individuals to any other website, for any purpose.
• Modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile, or disassemble any portion of the Service, or encourage others to do so.
• Develop or use any third-party applications that interact with the Service or other members' content or information without obtaining our written consent.
• Use, access, or publish the Mango application programming interface without obtaining our written consent.
• Probe, scan, or test the vulnerability of our Service or any system or network.
• Encourage or promote any activity that violates this Agreement.

6. Mango reserves the right to investigate and take appropriate legal action in response to any unlawful or unauthorized use of the Service, which may include the termination of your account.

6. Any software provided by us may automatically download and install upgrades, updates, or other new features. You may have the ability to adjust these automatic downloads through your device's settings.

7. Granting of Rights to Mango

7. By creating an account, you hereby grant Mango a worldwide, transferable, sub-licensable, royalty-free, right and license to host, store, use, copy, display, reproduce, adapt, edit, publish, modify, and distribute information that you authorize us to access from third parties, such as Facebook or Google, as well as any information that you post, upload, display, or otherwise make available (collectively referred to as posted content) on the Service or transmit to other members. Mango's license to your posted content shall be non-exclusive, except in the case of derivative works created through the use of the Service. For instance, Mango shall have an exclusive license to screenshots of the Service that include your posted content. Furthermore, for the purpose of preventing the unauthorized use of your posted content outside of the Service, you authorize Mango to take action on your behalf against infringing uses of your posted content by other members or third parties. This includes the authority, though not the obligation, to issue notices in accordance with 17 U.S.C. § 512(c)(3) (DMCA Takedown Notices) on your behalf if your posted content is taken and used by third parties outside of the Service. Our license to your posted content is subject to your rights under applicable law, such as laws governing personal data protection to the extent that any posted content contains personal information as defined by those laws. This license is limited to the purpose of operating, developing, providing, and improving the Service, as well as researching and developing new services. You acknowledge that any posted content you place or authorize us to place on the Service may be viewed by other members and individuals visiting or participating in the Service who receive shared content from other Mango members.

7. You confirm that all information submitted during the creation of your account, including information submitted from your Facebook or Google account, is accurate, truthful, and that you possess the right to post the content on the Service and grant the aforementioned license to Mango.

7. You understand and agree that we may monitor or review any content you post as part of the Service, and we reserve the right to delete any content, in whole or in part, that we deem to violate this Agreement or potentially harm the reputation of the Service.

7. When engaging with our customer care representatives, you agree to conduct yourself respectfully and courteously. We reserve the right to immediately terminate your account if we perceive your behavior towards our customer care representatives or other employees as threatening, harassing, or offensive.

7. In consideration for allowing you to use the Service, you acknowledge and agree that we, our affiliates, and our third-party partners may display advertisements on the Service. By providing suggestions or feedback to Mango regarding our Service, you grant Mango the right to use and share such feedback for any purpose without providing compensation to you.

7. Please note that Mango may access, store, and disclose your account information and posted content if required by law, to fulfill our agreement with you, or in good faith belief that such access, storage, or disclosure serves a legitimate interest. This may include, but is not limited to: (i) complying with legal processes, (ii) enforcing the Agreement, (iii) responding to claims of third-party rights infringement resulting from any content, (iv) addressing your customer service requests, or (v) protecting the rights, property, or personal safety of Mango or any other individuals.

8. Community Rules

8. By utilizing the Service, you agree not to:

• 8. Utilize the Service for any harmful or malicious intent.
• 8. Use the Service with the intention of causing damage to Mango.
• 8. Violate our Community Guidelines, as periodically updated.
• 8. Engage in spamming, soliciting money, or defrauding any members.
• 8. Impersonate any individual or entity, or use images of another person without their explicit permission.
• 8. Bully, stalk, intimidate, assault, harass, mistreat, or defame any person.
• 8. Post content that infringes upon or violates the rights of others, including rights of publicity, privacy, copyright, trademark, or other intellectual property or contractual rights.
• 8. Share content that is hate speech, threatening, sexually explicit, or pornographic.
• 8. Post content that incites violence, contains nudity, graphic violence, or gratuitous violence.
• 8. Promote racism, bigotry, hatred, or physical harm of any kind against any individual or group.
• 8. Solicit passwords or personal identifying information for commercial or unlawful purposes from other members, or distribute another person's personal information without their permission.
• 8. Use another member's account, share an account with another member, or maintain more than one account.
• 8. Create a new account after having your account terminated, unless you have obtained permission from us.

8. Mango reserves the right to investigate and terminate your account without refunding any purchases if you have violated this Agreement, misused the Service, or engaged in inappropriate or unlawful behavior, whether on or off the Service. Additionally, in certain cases, we may terminate your account for violating the terms applicable to any of the Match Group family of businesses, which includes services such as OkCupid, Plenty of Fish, Match, Meetic, BlackPeopleMeet, LoveScout24, OurTime, Pairs, ParPerfeito, and Two. Your authorization to use the Service will be automatically revoked if you breach these rules or our Community Guidelines.

9. Content Posted by Other Members

9. Mango retains the right to review and delete any Content that violates the terms of this Agreement. However, it is essential to understand that the member who posts such Content bears the exclusive responsibility for it. Mango does not provide any guarantee regarding the compliance of all Content with the provisions outlined in this Agreement. Should you come across any Content on the Service that violates this Agreement, we kindly request that you promptly report it within the Service or through our designated contact.

10. Purchases:

In general

Mango may, from time to time, make available products and services for sale (in-app purchases) via authorized payment platforms such as the App Store, Google Play Store, carrier billing, Mango direct billing, or other approved platforms. If you opt to engage in an in-app purchase, you will receive a prompt to confirm the purchase through the designated payment provider. Your chosen payment method, whether it is a card or a third-party account like the Google Play Store or App Store (Payment Method), will be charged for the specific in-app purchase at the displayed prices for the selected service(s), inclusive of any applicable sales or similar taxes imposed on your payments. By doing so, you are granting Mango or the relevant third-party account the authority to charge you accordingly.

Automatic Subscription Renewal and Card Payments

When you purchase an auto-recurring periodic subscription through an in-app purchase, please note that your Payment Method will continue to be billed for the subscription until you decide to cancel it. Following the initial subscription commitment period, the subscription will automatically extend for an indefinite duration at the agreed price, unless you cancel before the renewal date. As per the Agreement, your card payment information will be securely stored and used for subsequent automatic card payments.

If you have any objections regarding a payment that has already been made, please direct your concerns to Customer Support. If you were billed directly by Mango or through a third-party account, such as the App Store, you can contact them to raise your objections. Your bank or payment provider can also provide you with further information regarding your rights and applicable time limits. However, it is important to note that you are still responsible for paying any outstanding amounts, even if you withdraw your consent to automatic card payments.

To change or terminate your subscription, we recommend logging into your third-party account or accessing the Settings within the Mango application, if applicable. Follow the provided instructions to cancel or terminate your subscription, even if you have previously deleted your account or removed the Mango application from your device. Deleting your account or the application itself does not automatically cancel your subscription. All funds charged to your Payment Method will be retained by Mango until you officially terminate or cancel your subscription on Mango or the relevant third-party account.

Upon terminating or cancelling your subscription, you will retain access to the subscription until the end of the current subscription term. After that, your subscription will not be renewed.

For our members residing in Germany, please be aware that you have the right to terminate your subscription with one-month notice after it has been renewed, and this right remains unaffected even in the case of termination for cause.

Additional Terms for Direct Payments to Mango

If you choose to pay Mango directly using your Payment Method, it is important to understand the following terms. Mango reserves the right to rectify any billing errors or mistakes, even if payment has already been requested or received. In the event that you initiate a chargeback or reverse a payment made using your Payment Method, Mango may, at its sole discretion, immediately terminate your account.

You have the ability to modify your Payment Method information by visiting Mango's website and accessing the Settings section. In the event of a failed payment due to expiration, insufficient funds, or any other reason, and if you do not update your Payment Method information, terminate, or cancel your subscription, you will remain responsible for any outstanding amounts. By doing so, you authorize us to continue billing your Payment Method, as updated, which may result in changes to your payment billing dates. Additionally, you provide us with authorization to obtain updated or replacement expiration dates and card numbers for your credit or debit card, as provided by the issuer. The specific terms and conditions of your payment will be based on your chosen Payment Method and may be subject to agreements between you and the financial institution, credit card issuer, or other provider of your selected Payment Method.

Virtual Items may be available for purchase or earning within the Service. These Virtual Items are limited, personal, non-transferable, non-sublicensable, and revocable licenses that allow you to use virtual products or exchange them for other virtual products, such as virtual coins or units. The Virtual Item balance displayed in your account does not possess real-world value or represent stored value, but rather serves as a measure of your license's extent. There are no fees associated with unused Virtual Items; however, the license for Virtual Items will terminate in accordance with the terms outlined in this Agreement if Mango discontinues the Service or if your account is closed or terminated. Mango, at its sole discretion, reserves the right to charge fees for accessing or using Virtual Items and may distribute Virtual Items with or without charge. Mango retains the authority to manage, regulate, control, modify, or eliminate Virtual Items at any time. In exercising these rights, Mango assumes no liability to you or any third party.

It is important to note that Virtual Items can only be redeemed within the Service. All purchases and redemptions of Virtual Items made through the Service are considered final and non-refundable. The provision of Virtual Items for use within the Service begins immediately upon acceptance of your purchase. You acknowledge that Mango is not obligated to provide refunds for Virtual Items for any reason and that you will not receive monetary compensation or any other form of reimbursement for unused Virtual Items in the event of account closure, whether voluntary or involuntary.

Refund Policy and Pricing

Refunds: In general, all purchase charges are nonrefundable, and there will be no refunds or credits for partially used periods. However, we may consider refunding a subscription within fourteen days of the transaction date if a refund is requested or if the applicable laws in your jurisdiction allow for refunds.

To request a refund:

• If you made a purchase using your Apple ID, refunds are handled by Apple, not Mango. Please go to the App Store, click on your Apple ID, select Purchase history, locate the transaction, and click Report Problem. Alternatively, you can submit a refund request at https://getsupport.apple.com.
• If you made a purchase using your Google Play Store account or through Mango directly, please contact our customer support with your order number for the Google Play Store (order number can be found in the confirmation email or by logging in to Google Wallet) or Mango (order number available in your confirmation email).

If you exercise your right of cancellation, except for purchases made through your Apple ID, which is controlled by Apple, we will refund (or request Google to refund) all payments received from you promptly and within 14 days of receiving notice of your decision to cancel the Agreement. The refund will be processed using the original payment method. Please note that no fees will be charged as a result of the refund.

For purchases made through other payment platforms not mentioned above, kindly request a refund directly from the third-party merchant responsible for the purchase.

Please be aware that orders for the delivery of digital content, without a physical medium, cannot be canceled once the order processing has commenced with your explicit prior consent and acknowledgment that cancellation rights will be forfeited. This policy applies to purchases of Virtual Items, which are considered final and non-refundable.

Pricing: As a global business, Mango has varying pricing structures influenced by various factors. We frequently offer promotional rates, which may differ based on region, subscription duration, bundle sizes, and more. Additionally, we regularly test new features and payment options to enhance our services.

11. Notice and Procedure for Copyright Infringement Claims

If you believe that your copyrighted work has been copied and improperly posted on our Service, thereby constituting copyright infringement, please proceed to submit a takedown request using the designated form found here.

When reaching out to us regarding alleged copyright infringement, kindly ensure that your communication includes the following information:

1. An electronic or physical signature of the authorized person acting on behalf of the copyright owner.
2. A clear description of the copyrighted work that has allegedly been infringed.
3. Precise details regarding the location of the material on our Service, in a manner reasonably sufficient for us to locate the material in question.
4. Your contact information, including your address, telephone number, email address, and the identity of the copyright owner.
5. A written statement from you confirming that, to the best of your knowledge, the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
6. A statement made under penalty of perjury, affirming that the information provided in your notice is accurate and that you are either the copyright owner or authorized to act on behalf of the copyright owner.

Please be aware that Mango is committed to upholding copyright protection, and as such, we will terminate the accounts of repeat infringers.

12. Disclaimers.

Mango provides the Service on an as is and as available basis, in accordance with applicable law. Mango does not provide any warranties, whether express, implied, statutory or otherwise, regarding the Service (including all its content). This includes, but is not limited to, any warranties of satisfactory quality, merchantability, fitness for a particular purpose, or non-infringement. Mango does not guarantee that the Service will be uninterrupted, secure, or error-free. Nor does it guarantee that any defects or errors in the Service will be rectified. Furthermore, Mango does not warrant the accuracy of any content or information obtained through the Service.

Mango accepts no responsibility for any content posted, sent, or received by you, another member, or a third party through the Service. Any material downloaded or obtained through the use of the Service is solely at your discretion and risk.

13. Third Party Services.

The Service may feature advertisements, promotions, and links to external websites or resources provided by third parties. Mango bears no responsibility for the availability or lack thereof of such external websites or resources. Should you choose to engage with the third parties accessible through our Service, your relationship with them will be governed by their own terms. Mango is not liable or accountable for the terms or actions of these third parties.

14. Limitation of Liability.

To the fullest extent permitted by applicable law, Mango, its affiliates, employees, licensors, and service providers shall not be liable for any indirect, consequential, exemplary, incidental, special, punitive, or enhanced damages, including but not limited to loss of profits, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses. This includes damages arising from: (I) your access to or use of, or inability to access or use, the Service; (II) the conduct or content of other members or third parties on, through, or following the use of the Service; or (III) unauthorized access, use, or alteration of your content, even if Mango has been advised of the possibility of such damages. In no event shall Mango's aggregate liability to you for all claims relating to the Service exceed the greater of the amount paid, if any, by you to Mango for the Service and USD 100 while you have an account.

Some jurisdictions may not allow the exclusion or limitation of certain damages, so the exclusions and limitations stated in this section may not apply to you fully or in part.

15. Indemnity by You.

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Mango, its affiliates, and their respective officers, directors, agents, and employees from and against any and all complaints, demands, claims, damages, losses, costs, liabilities, and expenses, including attorney's fees, arising out of or related in any way to your access to or use of the Service, your content, or your breach of this Agreement.

16. Entire Agreement; Other.

This Agreement, including the Privacy Policy, Cookie Policy, Safety Tips, Community Guidelines, and Arbitration Procedures (if applicable to you), along with any disclosed and agreed-upon terms for additional features, products, or services purchased from Mango, constitutes the entire agreement between you and Mango regarding the use of the Service. If any provision of this Agreement is determined to be invalid, the remainder of the Agreement shall continue in full force and effect. The failure of Mango to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. You acknowledge that your Mango account is non-transferable, and all rights to your account and its content terminate upon your death. No agency, partnership, joint venture, fiduciary, or employment relationship is created as a result of this Agreement, and you may not make any representations on behalf of or bind Mango in any manner.
